History of the CLFOA

Our Beginning

The Chestermere Lakefront Owners Association (CLFOA) is one of the longest running groups in Chestermere. The Association was incorporated in 1959 as the Chestermere Cabin Owners Association (CCOA). It was primarily a social club at first and for years hosted dances at the old hall where the Chestermere Rockyview Recreation Centre (CRRC) now stands. The hall had tires under the floor and made for hilarious dancing. During the winter months regular social events were held in Calgary. Boat parades, dances, and the waterski club with their slalom course and plywood jump were some of the highlights of that time. The cabin owners leased lots from the Western Irrigation District (WID) from approximately 1944 until the late 1970s and paid an annual lease fee.

Lot Leases and Land Sale, 1975

While Chestermere was still a hamlet the lot leases were about to expire. After many meetings with the WID, the MD of Rockyview, and the Provincial Government, CCOA board member Vaughan Smith discovered that the WID had offered to sell the lands to the Government of Alberta. Smith then made the motion to offer the WID $1,000.000.00 which was passed by one vote after lengthy discussions and arguments for and against the purchase. During negotiations, the offer was increased to $1,500,000.00 which was accepted by the WID. The association then formed the Chestermere Cabin Owners Co-Operative as the legal instrument to facilitate the purchases, gathered deposits, arranged financing, and finally sold the lots to each member for around $3500.00, depending on the size of the lot. The Summer Village of Chestermere Lake soon grew out of this transaction and our first Council was made up entirely of lakefront residents. 

Chestermere Village Association

In 1978 the CCOA (Cooperative) was reformed as the Chestermere Village Association, and the coop was liquidated. The Chestermere Village Association continued to host social events and raise money for the Community Hall building fund, children’s parks, and other sports facilities as the community grew. The association was also instrumental in implementing the Volunteer Fire Protection Group for the village, and in 1981 it presented the Village with a fire truck and required equipment.  

Restrictive Covenant 1976

In 1976 a Restrictive Covenant was initiated by the CCOA (Cooperative) and was successfully registered on the residential lakefront lots with the Land Titles Act of Alberta,  limiting commerce and multiple dwellings on these lots,  and titles still reference this covenant today.  Although the City of Chestermere allowed a few smaller residential lots on north West Chestermere Drive with special circumstances,  and the condos on the north end of East Chestermere Drive were permitted years ago,  this covenant has protected lakefront properties from duplexes, multi-dwelling construction, and commercial development on these residential lots over the years.

Irrigation Fees

The WID started to charge the people around the lake for irrigation in the 1980s. They sent out utility bills, and some of the amounts reported were in excess of $800.00. When the lakefront residents refused to pay, the WID started lowering the lake level, which resulted in injuries, large fish kills, and excessive weed growth. In 1990, the Chestermere Lakefront Owners Association (CLFOA) was incorporated,  and the members rallied in support of the Association by contributing funds, hiring a lawyer, and eventually resolving that dispute in court.

Another Land Purchase

In 2004 the WID attended the Annual General Meeting of the Chestermere Lakefront Owners Association and explained that they had withheld a floodplain around the lake when the lots were purchased from them. Their infrastructure was vastly improved and they felt that they no longer wanted to be involved in neighbor disputes or liability. Supplying irrigation water to farmers was their focus, so they proposed to sell the remainder of the lots to each lakefront owner. They had set an asking price of $18.00 per square foot, and because of the irregular shoreline some people would not be required to purchase any land, and others would have to spend more than $80,000.00.  Not many people were even aware that they didn’t own the land to water’s edge, so this came as a huge shock to lakefront owners. That meeting ended in a near riot.

 

Once again, lakefront owners rallied to support the Board of Directors and raise funds for a legal battle. The members of the CLFOA worked extremely hard researching and negotiating for several years. They hired an appraiser, a lawyer, and tried unsuccessfully to urge Town Council to get involved, before our MLA Rob Anderson became involved in brokering the final deal between the lakefront owners, the Town of Chestermere, and the WID. The WID was very creative during these meetings suggesting they could add a row of homes in the middle of the lake, or drain most of the lake, and their asking price escalated to almost $40.00 per square foot during this process while lively negotiations ensued.  Finally, it was decided the Town of Chestermere would purchase the floodplain land around the lake for approximately $6,000,000.00, subdivide it, and sell each portion to the respective lot owner. This land was then added to each lot title.  Each lot owner also purchased a piece of lakebed land which extended lot sizes to approximately five feet past the end of the docks. Costs to each property owner at that time was $7.60 per square foot for the land above the shoreline, and $3500.00 for each portion of the lot under water. The Town of Chestermere (now City) was also able to purchase some lakefront land for public use. There were several properties who disputed the land purchases for varying reasons, and although most of these were resolved, in 2022 a few still remained in dispute.

Use of Works Agreement

Prior to signing the land sale contracts, Board member Mel Werner recommended an agreement be drafted between Chestermere and the WID to govern how the lake was managed, and from his recommendation the “Use of Works Agreement” was developed and executed on September 1st, 2005, with the WID.   This contract protects the lake from large fluctuations in water levels and details which entity is responsible for water quality, the preservation of the lake, and maintenance and aesthetics of the Works facilities, and more.   It also sets out the fees that the City of Chestermere pays the WID each year for use of the lake, which have increased based on inflation indexes over the years.

Volunteers

A huge thank you goes out to everyone who was involved in resolving the earlier land ownership issues of the lakefront properties, and volunteers who have participated on the CLFOA Board and on sub-committees over the years.  There have been so many lakefront owners who volunteered for positions on the CLFOA Board or assisted the Board to keep members informed of any and all issues that affect them as lakefront owners.  The Board members donate countless hours canvassing Lakefront Owners, attending meetings, and researching all relevant issues that arise from time to time.  As technology has evolved, the door-to-door canvassing is less frequent, and the communication mailouts and phone calls have been replaced with email, the Facebook member page, and notices on the www.CLFOA.com website.  It takes dedication and constant effort to keep on top of changes in lakefront lot ownership, in order to deliver member communications and make sure new owners are aware and invited to become members of the CLFOA.  Thank you to our volunteers, past and present.
